I am the current Bac Sec Head of COWD, would like to inquire po regarding legalities on cancelling a Purchase Order after issuance of Notice of Award and Contract Agreement. Is it still possible to cancel it or not. Cancellation of the said PO will be due to financial concern. We could cite Section 41.c, "the Reservation Clause", of the Revised IRR of RA 9184 for the reason but our concern is if it is still possible to cancel the PO after issuance of NOA and Contract agreement. Hoping for a reply to this matter.
The Procuring Entity cannot invoke Sec.41 if there is already a contract/PO.
