Hi GPPB-TSO and other Procurement Practitioners! May I ask whether a change of procurement modality from Competitive bidding to Small-Value-Procurement may be possible for the procurement of Goods (Raw Materials for Production)? Thank you!

You need to check whether those goods do not fall under Shopping (Sec.52). Small Value Procurement presupposes the procurement does not fall under Shopping. Plus always remember the objective requirements of (1) prior approval of the HoPE, and (2) justification by the BAC. The purpose must be to promote efficiency and economy, and the price and terms must be most advantageous to the government.

Section 48.1 of the 2016 Revised IRR of RA 9184provides “Subject to the prior approval of the HoPE, and whenever justified by the conditions provided in this Act, the Procuring Entity may, in order to promote economy and efficiency, resort to any of the alternative methods of procurement provided in this Rule. In all instances, the Procuring Entity shall ensure that the most advantageous price for the Government is obtained”

Section 48.3 of the same provides that “The method of procurement to be used shall be as indicated in the approved APP. If the original method of procurement recommended in the APP was competitive bidding but cannot be ultimately pursued, the BAC, through a resolution, shall justify and recommend the change in the method of procurement to be approved by the HoPE. Such changes must be reflected in the APP to be submitted to the GPPB, pursuant to Section 7.4 of this IRR.”
