Can the BAC conduct post-qualification in completed contracts especially on construction? and if the TWG sees that there is a problem on the completed contract however the CPES points out that the contractor is compliant or very good however the TWG sees otherwise. Can the TWG still decides to recommend for the post-disqualification attaching pictures or the CPES will be the basis? Thank you!

BAC thru its TWG shall “VERIFY, VALIDATE AND ASCERTAIN” all statements and documents submitted by the LCB/HRB. I assume completed contract refers to SLCC which is one of the technical eligibility requirements.

The SLCC shall be supported by an Owner’s Certificate of Final Acceptance issued by the project owner other than the contractor or a final rating of at least Satisfactory in the Constructors Performance Evaluation System (CPES). In case of contracts with the private sector, an equivalent document shall be submitted.  TWG shall verify the submitted CPES rating during post-qualification.

To question the CPES rating would encroach on its function. 

TWG can always include its observations in the Post-Qualification Report.  However, it is up to the BAC to decide whether to post-qualify/disqualify the LCB/HRB on the bases of such information.

No. That will be going beyond the rules.

The post-qualification shall verify, validate and ascertain the veracity, authenticity and validity of all the other statements made and documents submitted by the bidder with the Lowest Calculated Bid/ Highest Rated Bid, using non-discretionary criteria, as stated in the Bidding Documents. 

The TWG, or principally the BAC for that matter, shall employ only non-discretionary pass/fail criterion based on the submissions. To use another evaluation system or criterion will be a violation of the rules.
