ISSUANCE OF NOA AND NTP FOR ALTERNATIVE METHODS OF PROCUREMENT

Good day!

I would just like to be clarified whether or not the issuance of the Notice of Award (NOA) and Notice to Proceed (NTP) is still required/mandatory for the following alternative methods of procurement:

1. Shopping

2. Negotiated Procurement - Emergency Cases,

3. Negotiated Procurement - Agency-to-Agency

4. Negotiated Procurement - Small Value Procurement

5. Negotiated Procurement - Direct Retail Purchase of Petroleum, Fuel, Oil and Lubricant, Airline Tickets, and Online Subscriptions

Section 54.3 of the IRR states:

In ALL (emphasis mine) instances of alternative methods of procurement, the BAC, through the Secretariat, shall post, for information purposes, the notice of award, contract or purchase order, including notice to proceed if necessary, in the PhilGEPS website, the website of the Procuring Entity concerned, if available, and at any conspicuous place reserved for this purpose in the premises of the Procuring Entity, except for contracts with ABC of Fifty Thousand Pesos (₱50,000.00) and below.

However, Item IV (L) of Annex H of the IRR (updated as of October 15, 2023) page 141 mentions the exception of the aforementioned alternative methods of procurement for the procedures in the issuance of the NOA and NTP. Does this mean NOA and NTP are not required for the said alternative methods of procurement?

Yes, you are right, NOA and NTP are not required those are the alternative modes.

No. I will still maintain that NOA, (Contract) and NTP are essential and mandatory.

What is the reason by the HoPE in entering into contract if the is no NOA?

What is the basis of issuing NTP is there is no contract?

Meanwhile, NTP is no longer necessary if the Contract already included details such as Contract Start Date and Contract End Date. That is essentially what an NTP is. If such details are aready stated in the Contract (such as in the case of Purchase Order), then a separate NTP is optional.
