Recently, our agency successfully awarded a contract thru public bidding for the provision of janitorial services encompassing 10 personnel, valued at 2,860,181.00. However, due to unforeseen circumstances and increased operational demands, we find it necessary to augment our workforce with an additional 3 personnel with an estimated worth of 858,054.42.

We are exploring the most appropriate legal avenue to accommodate this expansion within the existing contractual framework. To this end, we seek your expertise in determining the most viable option:

  1. Supplemental Contract: Would it be legally permissible to execute a supplemental contract to add the extra 3 personnel to the existing janitorial services agreement? We aim to ensure that the new hires are seamlessly integrated into our operations under the same contractual terms and conditions as the initial procurement.

  2. Variation Order: Alternatively, could we pursue a variation order within the current contract to accommodate the additional workforce?

  3. Negotiated Contiguous Agreement: Is there a possibility of negotiating a contiguous agreement to enlist the services of the additional personnel same as the infra projects?

With regards to this, we used NPM No 47-2015 as basis for the hiring of additional janitorial services.
