Good day, 

As part of our procurement process, we are currently planning to engage in a negotiated procurement contiguous/adjacent. However, upon attempting to create a notice on PhilGEPS, we noticed that there is no specific option available for "procurement: contiguous/adjacent."

In light of this, we seek guidance on whether this negotiated procurement is still required to be posted on PhilGEPS, considering the absence of a designated category for contiguous or adjacent properties. If so, could you please advise on the most appropriate category or method for posting such procurement notices?

We understand the importance of transparency and compliance with the Government Procurement Reform Act (RA 9184) and its implementing rules and regulations. Hence, we want to ensure that our procurement activities adhere to the prescribed guidelines, including proper posting on PhilGEPS.

Your prompt assistance and clarification on this matter would be greatly appreciated. Thank you for your attention to this inquiry.

For negotiated procurement - adjacent or contiguous, posting of the procurement opportunity is not required because the BAC will negotiate only with the contractor/consultant who has an ongoing project (adjacent or contiguous to the project to be procured) and has complied with the conditions and requirements for this modality.  For transparency, the NOA, NTP and contract resulting from the negotiation will be posted in PhilGEPS and agency website.

If you are looking for a standalone posting module for Negotiated Procurement Adjacent/Contiguous, there is none.

You can find the module to post the details of NP Adjacent/Contiguous in PhilGEPS posting after you have UPDATED your posting of the NTP+Contract in the procurement originally awarded through competitive bidding.

In accordance with Sec. 54.3 of the IRR, the NOA, Contract, and NTP shall be posted in the PhilGEPS for information purposes.
