Section 9 of RA 11917 stipulates that the minimum administrative fee that maybe charged by the Private Security Agency shall not be less than 20% of the total contract cost subject to the adjustment of DOLE. Will this provision runs counter the provision of Section 31 of 9184? Thank you.
There is no conflict between the two provisions of law. They can be harmonized.
RA 11917 applies not only to government contracts but to private contracts as well.
The provision under RA 9184 that says "There shall be no lower limit to the amount of the award." (not the bid price) In case of government procurement for security services, Sec.9 of RA 11917 will just take precedence.
