As per DOLE Department Order No 171 Series of 2017 Section 11, b, ii - (The place or work and terms and conditions governing the contracting arrangement, to include the agreed amount of the contracted job or work as well as the standard administrative fee of not less than ten percent (10%) of the total contract cost) But RA 9184 Section 31. Ceiling for bid prices - The ABC shall be the upper limit or ceiling for the bid prices. Bid prices that exceed this ceiling shall be disqualified outright from further participating in the bidding. There shall be no lower limit to the amount of the award. The DOLE D.O limits the admin cost of the bidders that it should not be less than 10% while RA 9184 Section states that there should be no lower limit of the amount of the award. Does this mean that bidders can offer admin fee below 10%?
